is one of the oldest and most respected environmental companies in
the lead-based paint industry and is nationally recognized for its
experience and expertise. We are extremely proud of our good
reputation and the fact that our client base of property owners and
developers is continually growing and that many of our clients have
been with us for over 15 years. We are active and well-respected
members of the New Jersey Apartment Association (NJAA), the New
Jersey Property Owners Association (POA), the Associated Builders
and Owners of Greater New York (ABO) and the Institute of Realty
Managers (IREM) as well as many other tri-state property oriented
associations.
It was an
opinion of many owners several years ago, that not doing any
lead-based paint testing was a benefit, and the philosophy was,
“what you did not know, you did not have to disclose, and;
therefore, could not hurt you”. LEW Corporation, loyal to our
property owners, understood that position and on many occasions
agreed. However, with the implementation of New Jersey’s newest
Lead-Based Paint Law, our clients now recognize that the above
opinion is certainly not a viable option any more.
Under New Jersey’s new law, what you don’t know can hurt you in
many ways.
By not knowing
whether or not your pre-1978 property has lead-based paint, you are
now legally obligated to assume ALL surfaces are painted with
lead-based paint. As a result, you are now required to pay $20.00
per unit, notify your residents of the new law regularly via a NJ
DCA created pamphlet, have your maintenance staff, your outside
vendors and all others whom may disturb a painted surface trained
and certified in Lead-Safe Work Practices, and maintain all these
records and documents for a minimum of 5 years. EVEN IF YOU
COMPLY WITH ALL OF THE ABOVE,
the state can and in many cases will, ORDER PROPERTY OWNERS by means
of a violation to HAVE THEIR property lead-based paint tested.
After 15 years
in business and lead testing in tens of thousands of units, we have
never tested a multifamily property where every surface was
identified as being painted with lead-based paint.
We have
issued hundreds of Lead-Based Paint Free certifications and now with
the implementation of NJ DCA’s new lead law we have issued numerous
Interior Lead-Based Paint Free Certifications exempting many units
from the $20.00 per unit administrative fee requirement and many of
the regulatory requirements.
